1. Account Creation: You can register for an Account on our Site to purchase as a Publisher or proceed as Influencer without the fee. Creating an Account is available for individuals aged 18 and above. Account registration is free for the Influencer and paid for Publisher, and you are responsible for all activities on your Account. Please notify HypeHeaven immediately in case of any security breaches or unauthorized use of your Account.
2. Accurate Information: When creating your Account, you must provide accurate information, including payment.
3. Account Suspension: HypeHeaven reserves the right to suspend or terminate your Account or access to the Site if your conduct violates this Agreement or for any other reason, at our sole discretion.

Payment Terms

The prices for services displayed on the Site are subject to change at our discretion. You are responsible for the prices in effect at the time of your transaction and any applicable sales, use, and excise taxes. For EU users only: In case of a dispute relating to these Terms, you may seek an amicable solution by contacting HypeHeaven directly. If an amicable solution cannot be reached, you can pursue alternative dispute resolution through the European Commission's Online Dispute Resolution website. If out-of-court resolutions fail, the dispute may be brought before the competent courts.

Binding Arbitration: Except for small claims described below, any dispute arising under these Terms will be resolved through binding arbitration administered by the Polish court, following its streamlined arbitration rules. The arbitration will occur in Poland, and the arbitrator's decision will be final and binding. Each party will bear its costs. Class-action claims are waived.

Small-Claims Option: You may pursue a breach of warranty claim in small-claims court instead of arbitration by providing written notice within 60 days of your purchase. Small-claims court proceedings are limited to individual disputes and cannot involve class-action suits.

No Waivers: Our failure to enforce any rights under these Terms does not waive our right to enforce them in the future, subject to applicable law.
